Appendix 112 - Will of George Kidner of Durston

This is the last Will and Testament of me George Kidner of Durston in the County of Somerset yeoman.

I give and bequeath unto and equally between my nieces Sarah, the wife of George Kidner, and Elizabeth Parsons, daughter of Edward and Sarah Parsons, all my household goods and furniture, Plate, linen, China and Books which shall be in or about my dwelling house the place of my residence at the time of my decease for their own use and benefit.

I give and bequeath unto my sister Ann Martin, widow, the sum of two hundred pounds and to my nephew and nieces Matthew Lovibond, Alfred Lovibond, Mary Lovibond, Susannah Lovibond, Elizabeth Pepperday, Sarah Kidner George Stone, Francis Stone, & Mary Stone and Elvia Stone the sum of fifty pounds apiece.

To my nephew Francis Kidner the sum of one hundred pounds and to my niece Jane Kidner, daughter of the said Edward and Sarah Parsons, the sum of one hundred pounds and to my said niece the said Elizabeth Parsons the sum of two hundred pounds and I direct that all the said several legacies shall be paid to my said sister and any nephews and nieces respectively by my executors hereinafter named within twelve Calendar months next after my decease.

I give and bequeath unto my nephew the said George Kidner the sum of three hundred pounds In Trust that he or his executors or Administrators so and shall as soon as conveniently may be after my decease lay out and invest the same in his or their name or names in Government or real securities in England with full power to alter and vary the same at his or their discretion and so and shall pay the interest, dividends and annual produce thereof unto my sister in law Mary Barrington and her assigns for and during the term of his natural life and from and after decease on Trust to pay and transfer and assign the said sum of three hundred pounds and the stocks funds and securities on which the same shall be invested unto & equally between William Rowsell, Charles Rowsell, Robert Rowsell, Sarah Rowsell Ann Potter and Elizabeth Morrish, sons and daughters of my said Sister in Law Mary Barrington by her former husband Charles Rowsell deceased.

I give and devise all and every my freehold lands and hereditaments situate lying and being in the parish of Stoke Saint Gregory in the said County unto and to the use of my brother John Kidner his heirs and assigns for ever.

I give and devise all and every my freehold lands and hereditaments situate lying and being in the parish of Lyng in the said County unto and to the use of my brother Samuel Kidner his heirs and assigns for ever.

I give devise and bequeath all that my freehold or long leasehold Close of Meadow Land called Nipenoor (?) situate lying and being in the parish of Creech St Michael in the said County unto and equally between my nephew Richard Kidner and my niece Mary Babidge and their respective heirs Executors Administrators and assigns as Tenants in Common and not as joint tenants.

I give devise and bequeath all that Close of Arable Land called Nearns (?) and also an orchard called Chilcotts situate lying and being in the said parish of Creech St Michael unto and to the use of my nephew the said George Kidner his heirs, executors, administrators and assigns.

All the Rest, Residue and Remainder of my Estate and Effects of what nature or kind soever and wheresoever situate I give and bequeath the same unto my nephew the said George Kidner his executors Administrators and assigns for his and their own use & benefit subject nevertheless to and I hereby charge the same with the payment of my just debts funeral and Testamentary expenses and the aforesaid legacies and I appoint my said nephew George Kidner sole executor of this my will and as to any messuages, lands and other hereditaments which at the time of my decease I shall be seized or possessed of either In Trust for any purpose or by way of mortgage I give devise and bequeath the same unto my said nephew George Kidner his heirs Executors administrators and assigns according to the natures and legal qualities thereof respectively.

And lastly I revoke all former and other wills by me at any time heretofore made in writing whereof I the said George Kidner the Testator have to this my last will and testament contained in two sheets of paper set my hand and seal to wit my hand to the first sheet and my hand and seal to this second and last sheet this fourth day of October 1836. Signed, sealed published and declared by the said George Kidner the Testator as and for his last will and testament in the presence of us who at his request in his presence and in the presence of each other have herunto set our names as witnesses. Proved at London 3rd August 1837 before the Worshipfull William Calverley Curteis Doctor of Laws & surrogate by the oath of George Kidner the Nephew the sole executor to whom Admon was granted having been first sworn duly to administer.

 

Made on the 4th October 1836 and proved on the 3rd August 1837
